These Terms of Use (“Terms of Use”) govern your use of our website www.hyperexpress.sd (the “Website”) and our Hyper Express mobile application (the “App”). The Website and Application are collectively referred to as the “Platform”.

Please read these Terms of Use carefully before using the Services.
  If you do not agree to these Terms of Use, you may not use the Services on the Platform, and we require that you uninstall the Applications. By installing/downloading/or even just using the Platform, you must contract with “Hyper Express” and agree to the Terms of Use and other “Hyper Express” policies (including but not limited to cancellation and refund policy, privacy policy, etc.). as posted on the Platform from time to time, effective on the date you download, install or use the Services, and create a legally binding arrangement to comply with.
The Platforms will be used by (i) natural persons who have reached the age of 18 and (ii) corporate legal entities, such as corporations. Where applicable, these Terms are subject to the country-specific provisions as set forth herein.

Use of the Platform and Services
All commercial/contractual terms are offered and agreed upon solely between the Buyers and Dealers.
  Commercial/contractual terms include but are not limited to price, taxes, shipping costs, payment methods, terms of payment, date, period, method of delivery, warranties relating to products and services, and after-sales services relating to products and services. Hyper Express does not have any kind of control, does not define, advise or is in any way involved in the offer or acceptance of these commercial/contractual terms between Buyers and Dealers. However, Hyper Express may provide support services to Merchants with respect to order fulfillment, payment collection, call center and other services, pursuant to independent contracts it performs with Merchants. Hyper Express is not responsible for any non-performance or breach of any contract entered into between Buyers and Merchants on the Platform. Hyper Express does not warrant and does not warrant that the respective Buyers and/or Merchants will carry out any transaction entered into on the Platform. Hyper Express is not responsible for unsatisfactory services, non-performance of services, damages or delays as a result of products that are out of stock, unavailable or reordered.

"Hyper Express" operates an e-commerce platform and assumes the role of facilitator, and does not enter at any time during any transaction between the buyer and the merchant on the platform or acquire any of the products or services provided by the merchant. At no time shall Hyper Express have any right, title or interest in the Products and Hyper Express shall not have any obligations or liabilities in connection with this contract between Buyer and Merchant. You agree and acknowledge that we are not responsible for:

      merchandise offered by stores or restaurants including, but not limited to, food ordering service that suits your requirements and needs;
      Merchant's goods fail to meet your expectations or result in any loss, damage or damage to you;
      availability or unavailability of certain items in the menu;
      The merchant serves incorrect orders.

The menu details and price list available on the platform are based on the information provided by the merchants and we will not be liable for any change, cancellation or unavailability. All menu and food images used on our platforms are representative only and may/may not match the actual menu/food ordered, and Hyper Express shall not be responsible or liable for any discrepancies in this aspect.

Personal information you provide
If you wish to use our Service, you must create an account on our website. To create your account, we will request personally identifiable information that can be used to contact or identify you, which may include your name, phone number, and email address.
We allow you to submit additional information that will be part of your profile. Other than the basic information we need to create your account, you will have to decide how much information you want to share as part of your profile. We encourage you to think carefully about the information you share and advise you to protect your identity and sensitive information. Of course, you can review and update your profile at any time.

You understand that the delivery times provided to you at the time of order confirmation are an approximation and may vary. We will not be liable for any delay in delivery of your order due to delay on the part of the seller/merchant to process the order or any other unavoidable circumstances.

Your order will only be delivered to the address you specified at the time of placing the order

  We reserve the right to cancel the order, at our sole discretion, in the event of any change in the place of delivery after the arrival of the delivery representative to your previous location. You are not entitled to any refund for that. Delivery in the event of a change of delivery location is at our sole discretion and we reserve the right to charge additional delivery fees if required.

You shall undertake to provide appropriate directions, information and authorization to accept delivery. In the event of any failure to accept delivery, or failure to deliver within the Estimated Time due to your failure to provide proper instructions or clearances, then such Goods shall be deemed to have been delivered to you and all risks and liabilities in connection with such Goods shall pass to you and you shall not be entitled to any refund thereof. Our decision in respect of this matter will be final and binding. You understand that our liability ends once your order has been delivered to you.

You may be asked to provide your credit card details or bank or debit card details to the approved payment gateways while making the payment. In this regard, you agree to provide valid and accurate credit card details or bank/debit card details to the approved payment gateways to avail the Services. You may not use a credit/debit card that you do not lawfully own, i.e. for any transaction, you must use your own credit/debit card. The information provided by you may not be used or shared with any third party unless required in connection with a fraud check or by law, regulation or court order. You are solely responsible for the security and confidentiality of your credit/debit card details. We expressly disclaim all liabilities that may arise as a result of any unauthorized use of your credit/debit card. You agree that we only provide services during the business hours of the respective merchants

Activities prohibited on the platform
The following is a partial list of the types of illegal or prohibited conduct on the Websites. Hyper Express reserves the right to investigate and take appropriate legal action against anyone who, in Hyper Express's sole discretion, engages in any of the Prohibited Activities. Prohibited activities include, but are not limited to, the following:

      use the Websites for any purpose in violation of laws or regulations;
      post content that infringes the intellectual property rights, privacy rights, rights of publicity, trade secret rights, or any other rights of any party;
      post Content that is unlawful, obscene, defamatory, threatening, harassing, abusive, defamatory, hateful, or embarrassing to any other person or entity as determined by Hyper Express in its sole discretion or in accordance with Local Community Standards;
      Post content that constitutes online bullying, as determined by Hyper Express in its sole discretion;
      post content that depicts any dangerous, life-threatening, or risky behavior;
      post phone numbers, street addresses, or last names of anyone;
      Posting URLs on external websites or any form of HTML or programming code;
      post anything that may be "spam", as determined by Hyper Express in its sole discretion;
      impersonate another person when posting content;
      Harvest or collect information about others, including email addresses, without their consent;
      allow any other person or entity to use your identity to post or display Comments;
      harass, threaten, stalk, or abuse anyone;
      Engage in any other conduct that restricts or inhibits any other person from using or enjoying the Websites, or that, in Hyper Express's sole discretion, exposes Hyper Express, any of its customers, suppliers, or other third parties to any liability or harm to any of them He writes; or
      Encourage others to engage in any prohibited activities as described herein.

Hyper Express reserves the right, but is not obligated, to do any or all of the following:

      investigate allegations that any Content posted on the Websites does not comply with these Terms of Use and determine in its sole discretion to remove or request removal of the Content;

remove content that is offensive, illegal, disruptive, or otherwise inconsistent with these Terms of Use;
      terminate User's access to the Websites upon any breach of these Terms of Use;
      monitor, edit or disclose any content on the Websites; And
      Edit or delete any content posted on the Sites, regardless of whether such content violates these standards.

modifications
Hyper Express reserves the right to change or modify these Terms (including our policies incorporated into these Terms) at any time by posting the changes on the Platform. It is highly recommended that you read these Terms regularly. You will be deemed to have accepted the revised Terms by your continued use of the Platforms after the date the revised Terms are posted.
 

paying off
Hyper Express reserves the right to introduce additional payment methods and/or remove existing payment methods at any time at its sole discretion. If you choose to pay using an online payment method, the payment will be processed by the third party payment service provider(s). With your consent, your credit/payment card information will be stored with our third party payment service provider(s) for future orders. Hyper Express does not store your credit card information or your debit card information. You must ensure that you have sufficient funds on your credit and debit card to fulfill the order payment. To the extent required, Hyper Express shall be liable for payments made on our Platforms including refunds, chargebacks, cancellations and dispute resolution, provided they are reasonable and justified and in accordance with these Terms.

cancellation
Hyper Express may cancel any order at any time due to unavailability of foods/products, out of coverage area and any other unavoidable circumstances.
